A brief introduction

I assist in the maintaining and running of a small wiki dedicated to the Festiniog Railway (http://www.festipedia.org.uk/wiki/Home_Page). This is a non commercial, volunteer run operation, purely to document the Festiniog Railway in many aspects (historical, geographical). The only commercial part of the operation is the purchase of the webspace on our ISP, which is paid by the FR's Heritage group. My own connection has been as an editor and developer since the project started.

I recently developed a page within this wiki for a particular type of wagon that has been recently been restored. Amongst the material I was given as background (from various sources) was a photo appearing in a releated book : Branch Lines around Portmadoc 1923-46 (1993) Vic Mitchell & Keith Smith, Middleton Press, ISBN 1-873793-13-8 They indicated that you were the copyright holder for the image

I have taken the liberty of scanning this and attach to ensure we refer to the correct picture.

I would like to use it within our page http://www.festipedia.org.uk/wiki/Wagon_54

Have e-corresponded with Warwick Burton, and he was quite happy for our usage of the original, subject to a couple of proviso's which I could easily accomodate The picture itself appears at this location: http://www.festipedia.org.uk/wiki/File:Wagon_54_type.jpg and appears in the text of an article, here: http://www.festipedia.org.uk/wiki/Wagon_54

Thanks for your assistance in this

Hi Keith

Vic Mitchell & Keith Smith (1993) Branch Lines Around Portmadoc 1923-46. Midhurst, Sussex: Middleton Press. ISBN 1-873793-13-8 (Picture 43).

We have now obtained an inter-library loan copy of Mitchell and Smith’s book. It seems to me that the original Mowat photograph was cropped for the above book and further cropped for the version which you possess. Brunel University owns the original Mowat photograph, but the copy in Mitchell and Smith’s book (picture 43) was supplied Mr W.R. Burton, 3 Fairway, Clifton, York, YO3 GQA (E-mail: admin@yorkwalk.fsnet.co.uk , tel: 01904 622303). You should seek permission from Warwick Burton for his photograph.

I’m attaching a copy of our original. Sorry about the poor quality.

Hope this helps

Regards

John

John

Thanks for getting back. A little of the back story.

I act as an editor for a wiki dedicated to the Festiniog Railway in Porthmadog, N Wales. A pure voluntary "thing."

There was a successful effort to restore a wagon on our railway about 10 years ago, and when I was researching into it, a person involved in the restoration provided, privately, some relevant material / photos he had acquired. - some, his own of the restoration, and some historical. I knew where copyrights existed for all but 1 photo - the one in question. It is not thought to be the restored wagon, but one of a similar type.

I made some enquiries and it appears to be a cropped version of one published in: Vic Mitchell & Keith Smith. Branch Lines Around Porthmadog 1923-46. Midhurst, Sussex, England: Middleton Press. ISBN = 1-873793-13-8 oclc =30306827 Picture 43. The ancknowledgements in that book indicate "Photo by C Mowat, and a contact address of W.R. Burton, 3 Fairway, Clifton, York.

I have searched online for any WR Burton, but in meantime, the possibility of you holding the materail was mentioned. I enclose a scan of the book picture, with an approximation of the cropped version marked. The usual disclaimer, no intention to usurp the copyright holders right.

One of the photographs in our Mowat collection shows the Portmadoc exchange sidings in circa 1930. I would therefore be grateful if you could supply a copy of your photograph so that we can check whether they are the same.

Also do you know whether your photograph of the Portmadoc exchange sidings has ever been published?

Kind regards

John

I am writing to this email address as a first contact, so please forgive if you are not the right department. I am looking to establish the copyright ownership of a photograph, which I am informed may be held by the university. I have detail that it was taken by a C Mowatt in approximately 1930 and is of the exchange sidings at Porthmadog. A copy is available that can be sent directly on request
